1. Who we are and what these terms apply to

OPTIMAL PACE RENTALS E.E. (O.P. RENTALS) rents scooters and ATVs/quads in Hersonissos, Crete.

These terms explain the basic rights and obligations for every booking and rental. The exact details of each specific rental — vehicle, dates, price, deposit, approved drivers, protection package — are set out in the Rental Agreement signed at delivery.

In the event of a conflict between these terms and the signed Rental Agreement, the Rental Agreement prevails, subject to the law.

2. Booking, confirmation and availability

The display of a vehicle or price on the website does not constitute a guarantee of availability.

A booking becomes binding only after its confirmation by us and the completion of any required payment or card authorisation.

The final price and specific terms are those shown in the booking confirmation and stated in the Rental Agreement.

3. Driver requirements and documents

The driver must hold a valid driving licence appropriate for the vehicle being rented. The licence must be current, legible and presented in its original form at delivery of the vehicle. Photographs, copies or digital images alone are not sufficient.

Scooter 125cc A1, A2 or A, or equivalent driving entitlement recognised in Greece
ATV / Quad B or equivalent category permitting the driving of the specific quadricycle in Greece

For licences issued outside the EU/EEA, an International Driving Permit may also be required together with the original national licence. The IDP does not replace the national licence; both must be presented where required.

Each protection package has minimum age and minimum licence-holding period criteria. The exact criteria are stated at the time of booking.

You may be asked for an identity card/passport and proof of payment before we deliver the vehicle to you.

If the driver does not hold the required licence or the necessary documents, the vehicle will not be delivered.

4. Who is permitted to drive

The vehicle may only be driven by the renter (provided the renter is declared as a driver) and those who have been expressly approved as additional drivers before delivery.

If someone else is paying (e.g. a parent, partner, company), the payment does not give that person the right to drive. If that person wishes to drive, he/she must be separately approved as a driver.

5. Prices, payments, deposit / pre-authorisation

Prices may vary depending on the season, rental duration, availability, booking channel and vehicle category.

The binding price is the one stated in the booking confirmation or in the Rental Agreement. Prior or indicative prices are not binding.

Before or at delivery, a deposit is required (card pre-authorisation, charge or cash). The deposit is payment security — it does not constitute a cap on liability.

Additional charges apply only where there is a specific reason and documentation.

6. Payer, cardholder and split payment

Payment by a third party (payer / cardholder) does not confer a right to drive and does not alter the usage rules or the protection packages.

The payer is liable only for the payments, pre-authorisations and charges that he/she expressly accepts in the Rental Agreement or in the payment authorisation.

If there are multiple payers (split payment), the exact shares are stated in the Rental Agreement.

7. Basic, CDW and SCDW — what they generally mean

Every rental automatically includes mandatory motor third-party liability insurance as required by law.

In addition, you may select a contractual package:

  • Basic — Does not reduce your liability for damage to the vehicle itself. Only the mandatory third-party insurance applies.
  • CDW — Reduces your first financial liability for specific external incidents, provided the terms and reporting obligations are met.
  • SCDW — Greater liability reduction than CDW, but does not eliminate all liability. The same exclusions continue to apply.

No package constitutes "full insurance", no package covers personal accident, medical expenses or personal belongings, and no package replaces the mandatory insurance.

8. What is generally not covered

Regardless of the package you select, the following do not become "covered":

  • Theft, disappearance, non-return of the vehicle.
  • Use by an unauthorised driver.
  • Driving under the influence of alcohol or substances.
  • Off-road, beach, dirt road, unsuitable surface.
  • ATV rollover (of any kind).
  • Tyres, rims, underside, frame, drivetrain.
  • Mechanical misuse, wrong fuel, ignoring warnings.
  • False declaration, failure to report an incident, non-cooperation.
  • Bodily injuries, medical expenses, personal belongings.

9. Permitted use, routes and surfaces

The vehicles are intended exclusively for suitable public paved roads.

Use on unpaved or unsuitable surfaces, dirt roads, beaches, sand, rocks, trails or on any route that does not constitute a suitable public road for the specific vehicle is prohibited.

Loading the vehicle onto a vessel, inter-island transport or departure from Crete is not permitted.

Certain destinations may require our prior written approval. Route approval lifts only the geographical restriction — it does not extend protection packages nor alter the remaining terms.

Violation of these rules may result in full liability and loss of the package.

10. Vehicle delivery and condition recording

At delivery, the external condition of the vehicle, the equipment, the kilometres/hours and the fuel level are recorded with photographs/video.

By signing, you accept that you received the vehicle in the condition recorded.

If you notice anything that was not recorded, you must report it before departing.

11. Vehicle return

The vehicle is returned at the time, at the location and in the condition agreed.

Upon return, the condition is compared with that at delivery. Any new damage or missing items are recorded.

Fair wear and tear from normal use is not charged.

The fuel policy is "same-to-same": you return it at the same level.

12. Accident, damage, fault or incident

If an accident, damage, fault, warning indicator or other incident occurs during the use of the vehicle, the Renter and every Approved Driver using the vehicle must safely cease use, contact the company immediately and must not continue use if doing so could worsen the damage or endanger themselves, third parties or the vehicle. Specific handling instructions are given on a case-by-case basis by the company.

Failure to comply with these obligations may affect your protection package.

13. Fines, losses, damages and post-rental charges

You are liable for fines, tolls, violations, administrative costs and consequences connected with use, breach or act/omission during the rental, to the extent they concern you under the Rental Agreement and the law.

Post-rental charges apply only if there is a contractual reason, documentation and notification. Indicatively: documented damage, missing items, cleaning beyond normal wear, recovery, fines and related administrative fees.

In special cases where the vehicle cannot be used due to a chargeable incident, a documented downtime charge may apply.

Double charging for the exact same cost does not apply.

14. Cancellations, late return and no-show

The applicable cancellation policy is displayed during the booking process and/or in the booking confirmation or written quote.

The rental concerns a specific vehicle or category and a specific performance period. The statutory exceptions to the right of withdrawal for vehicle rental services with a specific performance date apply, subject to mandatory law.

Late return without written approval may result in additional charges.

Non-appearance (no-show) does not automatically create a right to a refund.

15. Personal data, GPS / telematics

We process your personal data in accordance with the GDPR and Greek law, for rental management, legal obligations, safety and asset protection.

The vehicles may be equipped with GPS and telematics systems, which are used only for the purposes stated in the Privacy Notice, where applicable, and for lawful protection, tracking or recovery measures in the event of unauthorised use, non-return, loss or other contractually provided incident.

16. Communication, complaints, applicable law

We will examine every complaint in good faith and respond within a reasonable time.

These terms and the rental are governed by Greek Law. The competent courts are the courts of Heraklion, Crete, to the extent permitted by law.

Electronic signatures are accepted in accordance with applicable e-signature law.

Nothing in these terms excludes any right protected by mandatory law.
